Why do I have to pay my deductible when the other party is at fault?
When you choose or have to file a claim under your policy, the claim will be processed under your collision insurance. This coverage has a deductible, which must be paid no matter who is at fault. If your insurance company can prove the other party is liable, it will send him or her a bill for the full cost of the repairs. This is called a "subrogation demand." When the other party or his or her insurance company pays the demand, your insurance company will send you a check for your deductible.
